What Is a Legal DNA Test?

A legal DNA test — also known as a court-admissible paternity test or chain-of-custody test — is used when test results need to hold up in court. The collection, identification, and handling of the DNA must follow strict documentation protocols verified by an independent, trained professional.

Key Features of a Legal DNA Test at Test Smartly Labs:

  • Verified identity of all participants using government-issued ID

  • Third-party specimen collection by certified collectors

  • Chain-of-custody tracking from swab to results

  • AABB-accredited lab processing

  • Court-ready, notarized results

Whether the test is court-ordered or requested by an individual, we follow the exact process required to make sure your results are legally valid.

Why Would You Need a Legal DNA Test?

Legal paternity tests are commonly required for:

  • Child support

  • Custody disputes

  • Birth certificate name verification or amendment

  • IRS tax claims

  • Adoption cases

  • Estate settlements and inheritance

  • Immigration DNA testing

If you anticipate needing your results for any legal or governmental purpose, choose a court-admissible DNA test to save time, money, and complications later.

Understanding Chain of Custody in DNA Testing

Chain of custody refers to the complete and verifiable documentation of a DNA specimen’s collection, transfer, and testing process. Here’s how it works at Test Smartly Labs:

  1. Verified Identity
Each participant provides government-issued ID. For minors, additional forms of identification (e.g., Social Security card, insurance card, or birth certificate) may be required.

  2. Neutral Collection
A certified sample collector — who is not affiliated with any party — collects the DNA using a buccal swab. You cannot swab yourself in a legal test.

  3. Secure Transfer
Every sample is sealed, labeled, and tracked with full documentation from collection through testing.

  4. Lab Processing
Samples are tested at AABB-accredited labs to ensure quality, consistency, and legal recognition.

  5. Notarized Results
Final reports are notarized and delivered securely — suitable for presentation in any court or legal proceeding.

What to Bring to Your Legal DNA Appointment

Be fully prepared for your DNA or paternity test:

  • Government-issued ID (e.g., driver’s license or passport)

  • Child’s birth certificate, or secondary ID like insurance card or Social Security card

  • TSL Intake Form & HIPAA Disclosure

  • Authorization to release results

  • Be ready to provide a buccal swab (mouth swab)

  • Prenatal tests require a blood draw — stay well hydrated

  • No food one hour before testing (especially for infants)

  • A photo will be taken of each participant

  • Participants can go to different TSL locations — just coordinate ahead

Consider STI/STD Testing Along With Your Paternity Test

If you are sexually active and pregnant, it’s highly recommended that you also undergo comprehensive STI/STD testing — for both your safety and the health of your unborn child.

Why It Matters:

  • Many STIs are asymptomatic and can go unnoticed without testing.

  • STDs like HIV, hepatitis B, chlamydia, and syphilis can pass to the baby during pregnancy or childbirth.

  • Infections such as chlamydia can lead to preterm labor and low birth weight.

  • Untreated syphilis increases the risk of stillbirth or infant death.

Common Pregnancy-Affecting STDs:

STD Possible Effects
HIV Passed during labor or breastfeeding — requires early intervention
Hepatitis B Can affect newborn — vaccines and treatment necessary
Chlamydia May lead to preterm labor, low birth weight, and infant infection
Syphilis Increases risk of stillbirth and congenital defects

How STIs Are Treated During Pregnancy

The good news: most STIs are treatable during pregnancy.

Condition Treatment
Chlamydia, Gonorrhea, Syphilis Safe antibiotics
BV, Trichomoniasis Oral medications
Herpes, HIV, Hepatitis B Not curable, but manageable with meds

Early detection can protect both you and your baby — so don’t skip STI screening as part of your paternity or prenatal care.

How to Prevent STDs During Pregnancy

  • Use barrier protection like condoms

  • Maintain a monogamous relationship with an STI-negative partner

  • Get tested regularly, especially if you or your partner have other partners

  • Avoid all unprotected sexual contact if you suspect an STI
